Some Arizona Cardinals fans may have been upset when they found out that the team's new linebacker Joey Porter was arrested on suspicion of DUI in Bakersfield, California. However, The Huffington Post now reports that Mr. Porter and his DUI attorney will no longer have to worry about the drunk driving charge. This is because prosecutors in Kern County have found insufficient evidence from the suspected DUI incident.
A supervising district attorney explained in a statement, "Based upon the information that was provided to us by the CHP, we did not believe that there would be a reasonable likelihood that a jury would find Mr. Porter guilty beyond a reasonable doubt of the allegations."
Mr. Porter's arrest came last Saturday when he was accused of assaulting an officer, resisting arrest, and driving under the influence. He was taken into custody after police reported that the man's breath smelled of alcohol. Police also said that Mr. Porter slapped an officer's hand away when the officer tried to unlock the car door while the window was rolled down.
It's unclear of exactly how the football player was able to get his charges dropped, but one possibility could have to do with the credibility of the police officer who arrested him. Bakersfield Now reports that Mr. Porter's DUI attorney, Daniel Rodriguez, was the one who first questioned Officer Jeritt Greer's judgment when he arrested Joey Porter.
As it turns out, Officer Greer was also arrested for drunk driving last October. The man is also now under investigation for possible brutality, since Mr. Porter claims that Officer Greer manhandled him.
