One Arizona mother was arrested on Thursday on suspicion of two counts of aggravated DUI, but not because she was suspected of being under the influence of alcohol. She was arrested for drugged driving.
The Arizona Republic reports that the 29-year-old mother named Jessica Wayas has been accused of driving under the influence of meth, which allegedly caused an accident in Skull Valley. The Yavapai County's Sheriff's Office says that when driving her vehicle, Jessica Wayas crashed into a pickup truck that was being driven by a 71-year-old man. The woman had her two children in the car, who were not wearing seatbelts at the time of the crash.
Because children were in the car at the time of the alleged DUI crash, Jessica Wayas can face enhanced charges. In addition to being arrested on suspicion of two counts of aggravated DUI, the mother was also arrested on two counts of child abuse, aggravated assault and felony criminal damage.
It's common for Arizona DUI attorneys to get involved with cases that involve driving under the influence of drugs. Many people may not realize that drugged driving is illegal in the state of Arizona, even if it's just driving under the influence of prescription drugs. Yet many attorneys say that drug tests are not as accurate as the Breathalyzer tests that are used for suspected drunk drivers. This is because drugs like methamphetamine or cannabis can be traced in the body several days after usage. A person can realistically be tested positive for drugs, but may not be impaired by the drugs.
